✨ WHIMSICAL VACATIONS WITH AASHLY

By engaging our services, you acknowledge that you have read, understood, and agree to the following Terms & Conditions.

1. Agency Role

Whimsical Vacations with Aashly, operated by Aashly Santiago, acts solely as an independent travel advisor and intermediary for cruise lines, airlines, hotels, tour operators, and other travel service providers (“Suppliers”).

We do not own, manage, or operate these Suppliers and cannot guarantee their performance.

2. Third-Party Supplier Responsibility

All travel services are provided by independent third-party Suppliers. Whimsical Vacations with Aashly shall not be liable for any acts, errors, omissions, delays, cancellations, overbookings, schedule changes, or service failures of any Supplier.

We are not responsible for any injury, loss, damage, inconvenience, or delay caused by any Supplier.

3. Quotes, Pricing & Availability

All quotes are estimates only and do not guarantee pricing or availability until confirmed with payment.

- Prices are per person, in U.S. Dollars

- Pricing is subject to change at any time, including after payment, due to supplier or government-imposed increases such as taxes, fees, and fuel surcharges

- Availability is not guaranteed until booked and confirmed

4. Booking Confirmation

No reservations are held until payment is received and confirmed.

Quotes are valid only at the time provided and may change without notice.

Prompt payment is required to secure pricing and availability.

5. Payments & Authorization

By providing payment information, you authorize Whimsical Vacations with Aashly to process payments for approved travel services through third-party Suppliers.

- Charges may appear under the Supplier’s name

- You agree not to dispute legitimate charges consistent with approved travel arrangements

- Failure to meet payment deadlines may result in cancellation without refund

6. Chargebacks & Payment Disputes

You agree to contact Whimsical Vacations with Aashly directly to resolve any billing concerns prior to initiating a chargeback.

Unauthorized or unjustified chargebacks may be considered a breach of this agreement, and you may be responsible for any associated fees or collection costs.

7. Client Responsibility & Accuracy

You are responsible for providing accurate and complete traveler information, including full legal names (as they appear on government-issued identification), dates of birth, and travel details.

Whimsical Vacations with Aashly is not responsible for errors, fees, denied boarding, or cancellations resulting from incorrect or incomplete information provided by the client.

8. Airline & Travel Policies

Airline schedules, routes, and policies are subject to change without notice.

We are not responsible for:

- Missed connections

- Schedule changes

- Airline-imposed penalties

- Flights not issued directly through our agency

Travelers must comply with all airline and transportation policies, including baggage and check-in requirements.

9. Changes, Cancellations & Refunds

All changes and cancellations are subject to Supplier policies.

- Fees may apply

- Refunds, if available, are issued solely by the Supplier

- Whimsical Vacations with Aashly does not guarantee refunds

10. Travel Documentation & Entry Requirements

You are solely responsible for obtaining and maintaining valid travel documentation, including passports, visas, and identification.

- Passports typically must be valid for at least six months beyond return date

- Entry requirements may change at any time

We are not liable for denied boarding or entry due to improper documentation.

11. Health, Safety & Travel Risks

You acknowledge that travel involves inherent risks, including but not limited to illness, injury, delays, and unforeseen disruptions.

You voluntarily assume all risks associated with travel and release Whimsical Vacations with Aashly from liability related to such risks.

12. Travel Insurance

Travel insurance has been recommended and made available.

You understand:

- Coverage varies by policy

- Not all events may be covered

If you decline travel insurance, you accept full financial responsibility for any losses and release Whimsical Vacations with Aashly from liability related to uninsured events.

13. Supplier Default or Bankruptcy

Whimsical Vacations with Aashly is not responsible for the financial condition, insolvency, or default of any Supplier.

14. Force Majeure

We are not liable for failure or delay in performance due to events beyond our control, including but not limited to:

- Natural disasters, weather, pandemics, government actions, labor disputes, war, terrorism, or transportation disruptions.

15. Client Conduct

You agree to comply with all Supplier rules and regulations.

Disruptive, unsafe, or non-compliant behavior may result in denial of services or removal from travel without refund.

16. Right to Correct Errors

We reserve the right to correct any pricing, typographical, or informational errors at any time, including after booking. You will be notified promptly of any corrections.

17. Limitation of Liability

Whimsical Vacations with Aashly and Aashly Santiago shall not be liable for any direct, indirect, incidental, or consequential damages arising from travel or use of Supplier services.

18. Governing Law

This agreement shall be governed by the laws of the State of Minnesota. Any disputes shall be resolved within this jurisdiction.

19. Changes to Terms & Conditions

These Terms & Conditions may be updated at any time. The most current version will apply.

20. Acceptance of Terms

By booking travel services and/or signing required forms, you acknowledge that you have read, understood, and agreed to:

21. Final Acknowledgment & Assumption of Risk

You acknowledge and agree that travel involves inherent risks, including but not limited to delays, cancellations, illness, injury, supplier default, and unforeseen disruptions.

By engaging the services of Whimsical Vacations with Aashly, you voluntarily assume all such risks and agree to release, indemnify, and hold harmless Whimsical Vacations with Aashly, Aashly Santiago, and its affiliates from any and all claims, damages, losses, or expenses arising from your travel experience, except where prohibited by law.
